Investability Self-Assessment Terms

These supplemental terms apply to the Investability self-assessment. They sit on top of the terms of use and privacy policy already published on this website and do not replace them.

1. These terms, and what they add to

These supplemental terms apply to your use of the Investability self-assessment. They are in addition to the terms of use and privacy policy published on the website through which you reached the assessment, which continue to apply in full. Where these supplemental terms and that website’s terms of use cannot both be given effect on a question specific to the assessment, these supplemental terms prevail to the extent of the inconsistency, and only to that extent.

2. What the assessment is

The assessment asks you a set of questions about your own business and returns a score and a written commentary. It is provided free of charge and for general information only.

It is not a valuation. It does not state what your business is worth, what it would sell for, or what any buyer would pay. It is not financial, accounting, taxation, investment or legal advice, it does not take account of your objectives, financial situation or needs, and it is not a substitute for advice from a qualified adviser who knows your circumstances. You should obtain your own advice before acting on anything it says.

3. The answers are yours, and we do not check them

The assessment scores what you tell it. We do not verify any answer, we do not inspect your records, and we do not contact your accountant, your customers or your staff. If an answer you give is wrong, incomplete or out of date, the result will be wrong to the same degree, and we are not responsible for that.

You confirm that you are authorised to provide the information you enter, that providing it does not breach any obligation of confidence you owe to anyone else, and that any information you enter about another person has been provided lawfully.

4. Your reference code, your result link, and why you keep them to yourself

When you complete the assessment we give you a reference code and, where we provide one, a link to your result. Both are unique to that attempt. If you complete the assessment again you get a new code and a new link, and the earlier ones continue to point at the earlier result.

Anyone who has the code or the link can see that result. They are the only thing standing between your answers and whoever holds them, and we do not ask for a password on top, because the assessment is deliberately built so that we hold as little about you as possible.

So:

(a) we issue the code and link to you and to nobody else;

(b) you are responsible for keeping them confidential, and for anything that follows from giving them, forwarding them, or leaving them somewhere another person can reach them; and

(c) we are not liable for any loss arising from another person obtaining your code or link other than through our own act or omission. If you want to show your result to your accountant, your bank or a prospective buyer, that is exactly what it is for. Just understand that once you hand the code over you cannot take it back.

If you believe your code or link has reached somebody it should not have, tell us and we will retire it. A retired code cannot be reissued, and the result it pointed at can no longer be reached.

5. When we may contact you, and when we may not

We ask for your email address so that we can send you your result. Sending you your own result is the reason we collect it.

We will only send you anything else if you have expressly agreed to it by ticking the relevant box when you completed the assessment. An unticked box is not agreement. If you do not tick it, you will receive your result and nothing further.

Where you have agreed, you may withdraw that agreement at any time, by the unsubscribe link in any message we send or by contacting us, and we will act on it promptly. Withdrawing does not affect your result or your ability to reach it.

6. What we collect and what we do with it

We collect: the answers you give; your name, email address and any other contact details you choose to provide; and ordinary technical information that arrives with any web request, including a truncated and irreversibly hashed record of your network address, which we keep to prevent abuse of the service and for no other purpose.

We use that information to: produce and deliver your result; keep the service working and protect it from misuse; and, where you have agreed under clause 5, contact you.

We do not sell your information. We do not disclose your individual answers or your individual result to any third party, except where we are required to by law, to a service provider that hosts or transmits the service on our behalf under an obligation of confidence, or as described in clause 7A.

We keep your answers and your result for as long as your reference code remains valid, and afterwards for as long as we reasonably need them for the purposes above. Where we no longer need information that identifies you, we sever it from the answers rather than deleting the answers, so that what remains cannot be traced back to you.

7. Findings drawn from many businesses

We may produce and publish findings drawn from the answers of many respondents, for example how commonly a particular weakness appears across a group of businesses.

Any such finding will be aggregated and de-identified, and will never identify your business or be capable of doing so, whether on its own or combined with anything else we publish.

7A. Findings drawn from one organisation

Where several people from the same business have completed the assessment, we may prepare a combined view of their answers and give it to a principal of that business, meaning an owner, director or equivalent.

That business will be identified to that principal, because it is their own business and the point of giving it to them is that it is about their business. Your individual answers and your individual result will not be identified to them, and we will not tell them who took part.

We will not prepare or give such a view unless at least three different people from that business have completed the assessment, so that no single person’s answers can be read out of it. Three assessments completed by the same person count as one person for this purpose.

This may happen after you have removed your profile. Removing your profile severs your answers from you, as clause 6 describes. It does not withdraw those severed answers from a combined view of the business.

8. What the result does not do

The result is a snapshot produced from your answers on the day you gave them, scored against the version of the assessment published at that time. We may change the assessment, and a later version may score the same answers differently. We do not undertake to keep any earlier version available.

The result does not guarantee any outcome. It does not mean any buyer, investor, lender or adviser will reach the same view, and nothing in it should be presented to a third party as an independent assessment of your business, because it is not one. It is your own account of your own business, arranged and scored.

9. Our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Subject to that, and to the maximum extent permitted by law:

(a) the assessment is provided on an “as is” basis, and we give no warranty that it will be accurate, complete, uninterrupted or fit for any particular purpose;

(b) we are not liable for any loss or damage arising from your use of, or reliance on, the assessment or its result, including any business decision you make on the strength of it; and

(c) where liability cannot be excluded but may be limited, our liability is limited, at our option, to supplying the assessment again or paying the cost of having it supplied again.

We do not limit our liability for fraud, or for any other liability that cannot lawfully be limited.

10. The assessment itself belongs to us

The questions, the scoring, the weightings, the wording of the result and the assessment as a whole are our intellectual property. You may use your own result for your own purposes, including showing it to your advisers. You may not reproduce the assessment, copy its questions, or use it to build or train a competing product or service.

11. Changes, and how to reach us

We may change these supplemental terms. The version that applies to a result is the version published when you completed the assessment, and changing them does not change a result already issued.
